dc.description.abstracten The Concession Agreement for BR-116/101/SP/RJ is the document that establishes the basis for the concession and operation of the BR 116/101 Highway, connecting São Paulo and Rio de Janeiro. This contract aims to improve the quality, efficiency, and safety of the highway, defining the responsibilities of the concessionaire and the granting authority. It stands out for the inclusion of regulatory innovations, such as the Regulatory Sandbox, promoting tests of new solutions in the sector. The implementation of the Free Flow toll and a focus on environmental issues reinforce the modernization and sustainability in the management of the road infrastructure. Therefore, the contract reflects an adaptive approach, contributing to the improvement of the Brazilian road system. The objective of this investigation was to empirically and exploratorily verify the regulatory impact of the contractual arrangement related to the Regulatory Sandbox on the BR-116/101/SP/RJ Highway, in the implementation of the Free Flow toll. The focus is on the potential impacts of contractual norms in regulated sectors, especially aiming to suggest hypotheses and collecting data that allow for a cost/benefit analysis from a private perspective, in a simplified and preliminary format. The study also seeks to provide the basis for more robust empirical tests, with a quantitative and descriptive jurimetric foundation. The study was centered on the following hypothesis: "Are there indications that the implementation of the Free Flow toll had a positive regulatory impact?" The selected methodological approach for the development of this investigation was the comparative analysis and descriptive research of data obtained from the 1st and 2nd Quarterly Reports on the Experimental Regulatory Environment (Sandbox) submitted by CCR Rio-SP to the National Land Transportation Agency (ANTT), identifying and evaluating significant events that occurred due to the contractual arrangement of Free Flow, especially regarding the variables evasion, default, and collected amount chosen in this study. The third contractual amendment, which lays the groundwork for the Regulatory Sandbox for the BR-116/101/SP/RJ Highway, caused significant impacts on the implementation of the Free Flow toll. Quarterly reports highlight positive results. Furthermore, the diversification of payment methods, such as Automatic Vehicle Identification (AVI), Pix, and cards, demonstrates adaptation to user preferences, with AVI standing out. Challenges of evasion and default are pointed out, with an average reduction of 3.31% between the evaluated periods. The concessionaire highlights benefit such as improvement in travel and safety due to the Angra dos Reis Nuclear Power Plant. User satisfaction, though relevant, requires more consistent measurement. Challenges, such as blocked tags and plate reading, highlight the need for effective technical solutions. However, in-depth studies on the analyzed variables and an expanded monitoring period are necessary for a comprehensive understanding of the results and regulatory impacts. In summary, the implementation of the Free Flow toll seems to have generated positive impacts, especially financial and operational, but ongoing challenges require monitoring and adjustments in the regulatory model. The cost/benefit analysis should consider not only financial gains but also operational efficiency and user satisfaction, ensuring a holistic evaluation of the success of Free Flow as a toll model. pt_BR
