| dc.description.abstracten | Child sexual violence is a phenomenon that has worried the population and the legislator in Brazil, and it generates two major concerns: (a) full protection and (b) the punishment of the offender. These two concerns are concomitant and sometimes imply the need to hear the child in more than one opportunity, generating revictimization. And it is here that Law nº 13.431/2017, which established the System of Guarantee of the Rights of Children and Adolescents Victim, or Witness of Violence brings important measures to confront the problem and minimize secondary victimization. And one of these was the provision for integration of care policies, which is a detail through Decree nº 9.603/2018. With these disciplines, the question arose about whether the Integrated Centers can perform better the care of sexual violence victims, that is, the meeting on the same ceiling of the guarantee system members, for collaborative action and to avoid the multiplicity of harvesting of the victim’s report. Thus, the present research was based on the following question: Can Integrated Centers, as a public policy, contribute to the integral protection of children victims of sexual violence? Using the hypothetical-deductive method, which guides the present investigation, there will be an analysis of the importance of comprehensive care, based on the principle of best interest, and a comparison of the national model for centers of this nature, inspired by the American Child Advocacy Center and the Nordic Barnahus, with the experiences of São Paulo and Rio Grande do Sul. The hypothesis is that the center has the potential to contribute to the integral protection and removal of secondary victimization, especially in view of constitutional forecasts, the Statute of The Child and Adolescent, and the Laws already mentioned, but also in the face of the international obligations assumed by Brazil. To carry out this research, the first chapter will be discussed child sexual violence as a violation of human rights, while the second will be treated the psychological and socio-legal aspects of this violence that make it a complex problem to demand the action of various organs and knowledge. In the third chapter, there will be an analysis of the intervention and collaboration of the protective network in the face of child sexual violence, in which the duty of collaboration, the challenges of integration, and the potential of the Integrated Centers for respect of children’s human rights will be detailed. Throughout the research, we work with the hypothesis to be tested that the answer to the above question is positive, and the test will be conducted through bibliographic and jurisprudential research. At the end, it was concluded that Integrated Care Centers can contribute to the fight against child sexual violence, both because of their greater specialization and the bringing together of various services in the same space. | pt_BR |

Estas são concomitantes e implicam, por vezes, na necessidade de oitiva da criança, em mais de uma oportunidade, gerando revitimização. A Lei nº 13.431/2017, que estabeleceu o Sistema de Garantia de Direitos da Criança e do Adolescente Vítima ou Testemunha de Violência, trouxe importantes medidas para enfrentamento do problema e minimização da vitimização secundária. Uma dessas foi a previsão de integração das políticas de atendimento, que foi detalhada através do Decreto nº 9.603/2018. Questiona-se se os Centros de Atendimento Integrado podem contribuir para realização do atendimento das vítimas de violência sexual, isto é, se a reunião sobre um mesmo teto dos integrantes do Sistema de Garantias referido tem o potencial de contribuir para atuação colaborativa e para evitar a multiplicidade de colheita do relato da vítima. Assim, a presente pesquisa foi norteada pelo seguinte questionamento: Os Centros de Atendimento Integrado, como política pública, podem contribuir para a proteção integral de crianças vítimas de violência sexual? A partir do método hipotético-dedutivo, que guia a presente investigação, haverá análise da importância do acolhimento integral, partindo do princípio do melhor interesse, e comparação do modelo nacional para centros desta natureza, de inspiração no Child Advocacy Center americano e no Barnahus nórdico, com as experiências de São Paulo e Rio Grande do Sul. A hipótese é de que os Centros têm o potencial de contribuir para a proteção integral e afastamento da vitimização secundária, em especial diante das previsões Constitucionais, do Estatuto da Criança e do Adolescente e das Leis já mencionadas, mas também diante das obrigações internacionais assumidas pelo Brasil. Para realização da presente pesquisa, no primeiro capítulo, será discutida a violência sexual infantil como violação aos direitos humanos, enquanto, no segundo, serão tratados os aspectos psicológicos e sociojurídicos desta violência e que a tornam um problema complexo a demandar a atuação de vários órgãos e conhecimentos. No terceiro capítulo, haverá a análise da intervenção e colaboração da rede protetiva diante da violência sexual infantil, em que se detalhará o dever de colaboração, os desafios da integração e os potenciais dos Centros de Atendimento Integrado para o respeito aos direitos humanos das crianças vítimas. Ao longo da pesquisa, trabalha-se com a hipótese a ser testada de que a resposta ao questionamento acima é positiva, sendo que o teste será realizado através de pesquisa bibliográfica e jurisprudencial. Ao final, concluiu-se que os Centros de Atendimento Integrado podem contribuir para o enfrentamento da violência sexual infantil, tanto por sua maior especialização como pela reunião de diversos serviços no mesmo espaço. | pt_BR |
